Rules & Regulations
1) The H2O Lucky Duck Race is presented by Magic Beans Village and Safety Harbor Museum of Regional History, both charitable/non-profit organizations under Section 501(c)(3) of the Internal Revenue Code having Tax ID #20-2221276 (Magic Beans Village, 470 2nd Street N., Suite C., Safety Harbor, FL 34695) and Tax ID #59-1782315 (Safety Harbor Museum of Regional History, 329 S. Bayshore Blvd. Safety Harbor, FL 34695). Presenters will be both organizations under the name of H2O Lucky Duck Race.
2). A list of prizes and, after the event, a list of prize winners, can be obtained from the Presenter by sending a written request and a self-addressed stamped envelope to: H2O Lucky Duck Race, c/o Magic Beans Village, 470 2nd Street N., Suite C, Safety Harbor, FL 34695.
3). Ducks will be launched into the predetermined area of Tampa Bay on Saturday, May 8, 2010 at around 3:00pm and arriving approximately 30 minutes later at the Safety Harbor Marina, 110 Veterans Memorial Lane, Safety Harbor, FL. 34695. The race committee reserves the right to postpone or reschedule the event because of inclement weather, acts of God, or other circumstances beyond the committee's control.
4). Once the ducks are launched, they are on their own. No attempt to free or interfere with any duck is permitted, unless deemed necessary by the race committee.
5). All ducks entered will be provided by the Presenter and will remain the property of the Presenter.
6). Each duck will have a waterproof number corresponding to the adoption paper number. Multiple duck entries from an adoption paper will be assigned additional duck numbers for identification.
7). Winners of the guaranteed cash prizes will be determined based on the first 8 (eight) qualifying ducks to sequentially finish the race and be gathered in the duck trap. If a winning duck is an "orphan", a duck that has not been adopted, it will be disqualified as a prize winner. The potential winner of the Million Dollar Duck is in accordance with Rule #15.
8). Entrants must be 18 years of age or older (or have consent from parent or legal guardian) and a resident of the United States to adopt a duck or win a prize. Employees and officers of the Presenters, as well as family and household members of same, are not eligible to win the Million Dollar prize. Prizes will be awarded in accordance with the name appearing on the adoption paper.
9). All cash prizes will be awarded, except the Million Dollar Duck prize will be awarded only as set forth in Rule #15.
10). Only completed entry forms and on-line entries will be accepted. All entries mailed must be received by April 30, 2010 by 5:00 pm if not sold out by this date, to the address listed in Rule #2. If available, entries may be sold the day of the race at the Safety Harbor Marina, address listed in Rule #3. Entrants assume the risk of non-delivery of any entries to Presenters or an authorized representative of the Presenter.
11). Winners will be announced at the Safety Harbor Marina directly following the event. Winners need not be present to win. Winners will be notified by U.S. Certified Mail if not in attendance day of event. If a winner does not claim his or her prize within 30 days of the race date, Presenters will select an alternate winner through a random drawing from adoption papers. However, no alternate winner will be selected for purposes of the Million Dollar Duck.
12) Any and all taxes and similar fees are solely the responsibility of the prize winner. All winners must be legal residents of the United States of America and must present a valid Social Security number and government issued photo identification.
13) By adopting a duck, winners consent to the promotional use of their names and likenesses by the Presenter and its designees without additional compensation.
14) This event is subject to all local, state and federal laws and regulations and is void if prohibited by law.
15) Million Dollar Duck: The chance to win the “Million Dollar Duck” prize will be in accordance with the terms and conditions outlined by Odds On Promotions (“OOP”). There will be 2 chances to qualify to be the potential winner of the Million Dollar prize. The winning duck numbers are selected prior to the race and kept in a sealed security envelope. When the first adopted duck crosses the finish line and is gathered in the duck trap, a race official will determine whether the duck is one of the pre-selected Million Dollar Ducks. If it is, the duck adopter wins the Million Dollar grand prize*. If it is not, a race official or its designee will randomly select a second duck from all other ducks to cross the finish line and be gathered in the duck trap. A race official will determine whether the duck is one of the pre-selected Million Dollar Ducks. If neither of the two above-mentioned ducks is one of the pre-selected Million Dollar Ducks, the Million Dollar prize will not be awarded. The odds of being pre-selected as a potential winner of the Million Dollar Duck are approximately 1:3,000. The odds of being the qualifying duck(s) depend on the total number of qualified entries. *The Million Dollar prize is paid in 40 equal annual installments of $25,000 each, without interest. The prize award is solely the responsibility of OOP. Presenter has no liability to any Million Dollar Duck winner. Employees and officers of the Presenter, as well as family and household members of same, are not eligible to win the Million Dollar prize.
16) All decisions and interpretations of the rules and regulations will be made by Presenter, and its judgment will be final.
17) Presenters Magic Beans Village (CH19604) and Safety Harbor Museum of Regional History (CH1561) have complied with registration requirements of Chapter 496, Florida Statutes, “The Solicitation of Contributions Act.” A copy of the official registration and financial information may be obtained from the Division of Consumer Services by calling 1-800-435-7352 toll free within the State of Florida. 18) Chances of winning depend on the total number of qualified entries. No purchase or contribution is necessary to win. A purchase or contribution does not increase your chances of winning. The purpose of this event is to raise funds for the Presenters, but you may request a duck number for no donation by sending a self-addressed, stamped envelope along with your request to the H2O Lucky Duck Race, c/o

AGAINST ANY AND ALL INJURIES, LOSSES, DAMAGES, CLAIMS, CAUSES OF ACTION, OR
LIABILITIES OF ANY KIND WITH RESPECT TO THE RECEIPT OR USE OF ANY PRIZE IN ANY
RESPECT, PARTICIPATION IN THIS EVENT, OR ATTNEDANCE OF THE DUCK RACE.
